1. About these terms
These terms apply when you access or use the public Pinnacle Engine website, including its articles, calculators, downloads, forms and Knowledge Guide. By using the website, you agree to comply with them. If you do not agree, please stop using the website.
Browsing, submitting an enquiry, requesting a Growth Fit Call, downloading a resource or using a calculator does not create a client relationship. Paid work begins only after Pinnacle Engine and the client agree the relevant scope, fee and contractual terms in writing.
2. Who we are
3. Purpose of the website
The website explains Pinnacle Engine, Business Growth Engineering, the Business Growth Assessment, the methodology and implementation capabilities. It also provides educational articles, free resources, calculators, a Knowledge Guide and ways to contact Pinnacle Engine.
Public content is provided for general business information and education. It does not establish what a particular business should do.
4. General content is not personalised advice
Articles, calculator explanations, downloads, Knowledge Guide answers and other general website content are not a personalised Business Growth Assessment. They do not constitute legal, tax, accounting, investment or financial advice, and should not replace advice from an appropriately qualified professional where that advice is required.
Bespoke Business Growth Engineering work is different: it is scoped, investigated and agreed separately rather than delivered through general public content.
5. Business calculators
The ROI and lead-cost calculators apply arithmetic to figures entered by the visitor. Their outputs are illustrative mathematical estimates based on those inputs and the assumptions explained beside each tool. They are not forecasts, guarantees or promises of Pinnacle Engine performance.
Visitors should check input accuracy, test relevant assumptions and verify important commercial decisions independently. A calculator can organise a question; it cannot diagnose the wider business system.
6. Downloads and free resources
Downloads are provided for personal or internal business use. They may be shared with colleagues inside the same organisation for that purpose.
Unless Pinnacle Engine gives separate written permission, visitors must not:
- Resell or commercially redistribute a resource, whether unchanged or modified.
- Republish a resource as their own work or upload it to a paid resource library.
- Remove Pinnacle Engine branding and distribute the resource commercially.
- Use Pinnacle Engine branding in a way that implies affiliation, sponsorship or endorsement.
7. Intellectual property
Unless stated otherwise, Pinnacle Engine or its licensors own the intellectual-property rights in original website copy, graphics, frameworks, public report or template structures, downloads, branding, logos, diagrams and articles. Visitors may view and use them reasonably for personal or internal business purposes subject to these terms.
Pinnacle Engine does not claim ownership of third-party trademarks, licensed third-party materials, open-source software, public-domain material, or ideas and concepts that the law does not protect. No claim of registered trade-mark status is made unless expressly stated.
8. Acceptable use
Visitors must not:
- Use the website unlawfully or to infringe another person's rights.
- Attempt unauthorised access, probe or attack systems, circumvent security controls, obtain credentials, introduce malware or interfere with other users.
- Abuse forms, submit spam or use automated systems in a way that materially disrupts the website or its providers.
- Submit unlawful material or confidential third-party information without authority.
This section does not prohibit ordinary search-engine indexing, accessibility tools or proportionate automated access that does not disrupt the website, breach security or infringe rights.
9. Forms and visitor submissions
Information submitted through a form must be accurate to the best of the visitor's knowledge, lawful to provide and relevant to the request. General forms must not be used to send passwords, payment-card details, authentication credentials, malware, unlawful material or unnecessary sensitive personal information.
Personal information is handled under the Privacy & Cookie Policy.
10. Growth Fit Calls and enquiries
A Growth Fit Call request is an enquiry. Pinnacle Engine may review the information supplied and decide whether the enquiry appears relevant to its current work and capacity. Submission does not guarantee a call, and an introductory call does not oblige either party to proceed.
General discussion during that call is not a full Business Growth Assessment. Any paid Assessment is bespoke, separately scoped and agreed in writing.
11. Accuracy and availability
Pinnacle Engine aims to keep public information useful and accurate, but business practices, technology and external information change. Content may become outdated and errors may occasionally occur. Website availability cannot be guaranteed without interruption.
Public content may be corrected, updated or removed. A website change does not alter a separately agreed client contract.
12. External links
External links may be provided for convenience, attribution or supporting information. A link does not automatically endorse every statement, product or service on the destination site. Pinnacle Engine does not control an external site's availability, content, privacy practices or contractual terms.
13. Third-party names and trademarks
Third-party company names, product names and trademarks belong to their respective owners. A reference does not imply sponsorship, partnership or endorsement unless Pinnacle Engine states that relationship clearly.
14. Evidence and illustrative examples
Examples and decision trails are hypothetical unless clearly identified as genuine client evidence. Illustrative figures are not actual Pinnacle Engine client outcomes and do not guarantee an outcome. Future verified case studies will be identified separately and presented with relevant context and permission.
The Evidence page explains the standard applied before client proof is published.
15. Testimonials and reviews
The website does not currently present testimonials as verified client proof. If reviews or testimonials are added, they must reflect genuine experiences; relevant incentives or relationships should be disclosed, and one person's experience will not guarantee the same outcome for another.
16. No guaranteed outcomes
Business performance depends on factors including market conditions, offer, pricing, data quality, budget, sales process, operations and execution. Public website materials do not guarantee revenue, leads, profit, search rankings, advertising results, conversion improvements, cost reductions or business growth.
Any commitments relating to paid work are governed only by the written scope and contractual terms agreed for that engagement.
17. Liability for public website use
To the fullest extent permitted by law, Pinnacle Engine is not responsible for business decisions made solely from general public content where personalised investigation or appropriate professional advice would reasonably be required, loss caused by misuse of a calculator or free resource, or failures of third-party services outside its reasonable control.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited. This section does not govern liability under a paid client agreement.
18. Viruses and security
Pinnacle Engine takes reasonable steps to operate a secure website but cannot guarantee that publicly accessible technology will always be free from malware, vulnerabilities, interruptions or third-party attacks. Visitors should use suitable browser, device and network security protections. Nothing here excludes responsibility that cannot lawfully be excluded, including responsibility arising from negligence where applicable.
19. Linking to Pinnacle Engine
Ordinary links to public pages are welcome if they are lawful, accurate and do not falsely imply endorsement or frame the website deceptively. Pinnacle Engine may ask for a misleading, unlawful or rights-infringing link to be removed.
20. Changes to the website
Pinnacle Engine may update public content, improve tools, remove obsolete resources, change website structure or temporarily suspend features. Those changes do not amend an existing client contract.
21. Changes to these terms
These terms may be updated when the website, public features or applicable law changes. Material changes will be shown by updating the date above. Changes do not retrospectively alter accrued legal rights or a previously agreed client contract.
22. Other agreements
Privacy matters are governed by the Privacy & Cookie Policy. Paid services are governed by the Client Terms of Business, a proposal, Statement of Work or another written agreement. If a written client agreement conflicts with these terms regarding paid work, that client agreement takes priority for the relevant engagement.
23. Severability
If a provision is found invalid or unenforceable, it will be treated as removed or limited only to the extent necessary, and the remaining provisions will continue where legally possible.
24. No waiver
A delay or failure to enforce a provision does not necessarily waive the right to enforce it later.
25. Governing law and jurisdiction
These terms and non-contractual disputes relating to public website use are governed by the laws of England and Wales. The courts of England and Wales will normally have jurisdiction, but nothing in these terms removes a mandatory consumer right to bring proceedings in another competent UK jurisdiction where applicable.
